Hello so I was wondering.
The empty houses in the city, are they rp house for the players to claim in game and defend, and if they want to do them up, they need to later spend the tokens and gold as normal for a guild/player house?

If it is empty and open, you can rp as you wish in it. All Szith-Morcane rules are in effect as usual(i.e. if you are not a Drow you have no rights and can claim nothing and if you are a Drow hierarchical structure takes precedence), so stake it out defend it etc. as you like.
The rules for guild houses are yes in effect for anything to be claimed as a guild area. It does not belong to you.
Anything else you'll have to submit to the DM team as a proposal.
